TJCA Entered Federal Civil Rights Resolution Agreement Following Disability Discrimination Complaint

Mortellus

Dec 19, 2013

Federal investigation prompted an agreement requiring disability-related staff training, improved records practices, and parental reimbursement.

What happened: On August 28, 2013, a parent filed a complaint with the U.S. Department of Education's Office for Civil Rights (OCR), alleging that Thomas Jefferson Classical Academy discriminated against their child on the basis of disability during the 2012–2013 school year. The complaint alleged that the Academy failed to provide the student with a free appropriate public education (FAPE), as required under federal disability protections. OCR opened an investigation under Section 504 of the Rehabilitation Act of 1973 and Title II of the Americans with Disabilities Act.

What was established: On December 19, 2013, TJCA voluntarily entered into a formal resolution agreement with OCR. Under the agreement, the Academy committed to providing faculty and staff with training concerning specific disabilities, including autism, and the maintenance of exceptional children's records. The school also agreed to reimburse the parent $75 for travel expenses incurred while visiting the Academy to assist with the child's verbal assessment. TJCA was required to submit documentation verifying its training activities and reimbursement, and OCR retained authority to monitor implementation, request additional records, and pursue enforcement proceedings if the agreement was violated.

What was not established: OCR did not issue a formal finding that TJCA had discriminated against the student or violated federal law. The resolution agreement expressly stated that the Academy was not admitting discrimination or other wrongdoing. The agreement resolved the complaint through corrective commitments rather than a completed determination on the merits of the discrimination allegations. Its existence therefore establishes that federal investigators examined the complaint and that TJCA agreed to specific remedial measures, but not that every allegation was substantiated.

Subsequent developments: Under the 2013 resolution agreement, TJCA was required to complete corrective measures, including staff training and reimbursement to the affected family, subject to monitoring by the U.S. Department of Education's Office for Civil Rights (OCR).

The agreement provided for continued federal oversight until OCR determined that the Academy had fulfilled its obligations. The date on which that monitoring concluded, and documentation confirming completion of the required corrective actions, have not yet been established for this archive.

In September 2016, TJCA faced another federal disability-rights investigation, this time resulting in a formal OCR finding that the Academy had violated Section 504 of the Rehabilitation Act. Although the investigations involved separate complaints and circumstances, together they document repeated federal scrutiny of TJCA's treatment of students with disabilities.

TJCA Truth welcomes historical correspondence, school policy revisions, training materials, or other documentation concerning the Academy's implementation of the 2013 agreement and any subsequent changes to its disability-accommodation practices.

Report from the community: No independent firsthand account from the family involved in the 2013 OCR complaint has yet been obtained by TJCA Truth for publication. The family's concerns and the Academy's agreed corrective measures are documented in the federal investigation and resolution records. TJCA Truth welcomes firsthand perspectives from former students, families, educators, and staff familiar with TJCA's disability-accommodation practices during this period, including experiences requesting accommodations, navigating the school's complaint procedures, or observing changes following federal intervention. The privacy of students and families is particularly important in these matters. Contributors may request anonymity, and private correspondence will not be published without permission.
